Terms of Service
This Terms of Service Agreement (“Agreement”) is entered into between InternetMarketing444.com, a website owned by EVA & JJJ, Incorporated (“Company”), and the client (“Client”), collectively referred to as “Parties.” By engaging the Company’s marketing services, the Client agrees to the terms outlined herein.
1. Services Provided
The Company provides marketing and AI automation services, including but not limited to social media management, customer relationship management, AI sales management, AI scheduling management, AI phone/voice, and text management.
2. Payment Terms
- Payment for services is due at the start of services.
- All payments are non-refundable, including but not limited to payments for partially completed services or prepaid packages.
3. Cancellation of Services
- The Client may cancel services at any time by providing written notice to the Company at support@internetmarketing444.com.
- Upon receipt of the cancellation notice, the Company will cease all work related to the Client’s account at the end of the current billing cycle.
- No prorated refunds or credits will be issued for services canceled before the end of a billing cycle.
4. Client Responsibilities
The Client agrees to:
- Provide accurate and timely information necessary for the Company to perform its services.
- Respond promptly to the Company’s communications to avoid delays in service delivery.
- Comply with all applicable laws and regulations related to their business activities.
5. Company Responsibilities
The Company agrees to:
- Deliver marketing services in a professional and timely manner.
- Maintain the confidentiality of the Client’s proprietary information.
- Comply with applicable laws and regulations related to the services provided.
6. Privacy
By accessing internetmarketing444.com, you consent to EVA & JJJ’s Privacy Policy. The terms of the Privacy Policy are incorporated herein.
7. Limitation of Liability
- The Company is not liable for any indirect, incidental, or consequential damages resulting from the use of its services.
- The Company’s liability for direct damages shall be limited to the amount paid by the Client for the services in dispute.
8. Indemnification
The Client agrees to indemnify, defend, and hold harmless the Company, its employees, agents, and affiliates from any claims, liabilities, damages, or expenses arising from the Client’s use of the services, including but not limited to any breach of this Agreement.
9. Dispute Resolution
- Any disputes arising under this Agreement shall be resolved through mediation in San Bernardino County, California. If mediation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
- Each party shall bear its own costs associated with dispute resolution.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any legal actions or proceedings arising under this Agreement shall be brought exclusively in the courts located in San Bernardino County, California.
11. Modification of Terms
The Company reserves the right to modify this Agreement at any time. Any changes will be communicated to the Client in writing and will become effective immediately upon posting to the Company’s website or other notice to the Client.
12. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Entire Agreement
This Agreement constitutes the entire understanding between the Parties regarding the subject matter herein and supersedes all prior agreements, discussions, or understandings.
By engaging the Company’s services, the Client acknowledges that they have read, understood, and agree to be bound by the terms of this Agreement.
